Physicians who want to remain protected by the Indiana Medical Malpractice Act (Act) after July 1, 2017, must be sure liability limits on their policies match statutory increases before that date.
Under the law, physicians must carry coverage of $400,000 beginning July 1. According to the Indiana Department of Insurance (IDOI), physicians are required to have the new $400,000 limit on July 1, regardless of the policy renewal date. That means policies already in effect on July 1 must be endorsed to increase the limit to $400,000 as of July 1.
Also, a physician’s limit will be determined by the date of occurrence of the alleged malpractice, regardless of the policy term, according to the IDOI.
